CFHOJ Obtains Summary Judgment in Premises Liability Case
Congratulations to Ruben J. Olvera for obtaining summary judgment in a premises liability case filed in Bexar County, Texas. The Plaintiff filed a lawsuit after slipping and falling in the aisle of a grocery store where it was alleged several employees were present. The Plaintiff was seeking damages for certain personal injuries, including future medical expenses for a cervical surgery. After several depositions, a no evidence motion for summary judgment was filed and heard in District Court. The issue before the Court was whether the store had actual or constructive knowledge of an unreasonably dangerous condition when it was alleged that employees were in the vicinity at the time of the fall. After considering the motion, the evidence and arguments, the Court granted summary judgment and dismissed all of the Plaintiff’s claims.
